EXAMPLES OF ESSENTIAL JOB FUNCTIONS

Management reserves the rights to add, modify, change, or rescind the work assignments of different positions and to make reasonable accommodations so that qualified employees can perform the essential functions of the job.

  • Plans, develops, implements, and manages the work of the Risk Management division, workers’ compensation, safety, and other loss control programs including claims administration services with third party administrators; prepares bid specifications for services; evaluates contracts; negotiates renewals; implements and maintains a variety of insurance programs and policies to support loss mitigation activities; acts as the City’s liaison with third party administrators and consultants.
  • Prepares and evaluates performance measures, annual insurance budget expenditures for general liability and property, along with justification and narratives for each fiscal year. Reviews monthly for compliance and accuracy.
  • Oversees claim filing with insurance carriers for insured losses and subrogates claims for third party recovery.
  • Monitors claims adjudication process to stay updated on whether the City is liable for losses sustained; follows established guidelines to indemnify appropriate parties.
  • Completes comprehensive claims investigation, prepares files and transfers to Legal staff; may coordinate activity with outside legal counsel.
  • Attends hearing and/or trials to represent the City in quasi-judicial hearings and investigations; negotiates settlements as appropriate.
  • Manages loss control and occupational health activities by reviewing and analyzing losses and claim activity reports and determining appropriate responses and future preventive measures or training support activities.
  • Manages a variety of liability insurance policies by establishing and coordinating coverages with insurance agents, brokers, and carriers. Develops specifications for proposals, evaluates responses, and evaluates their effectiveness in protecting the City’s property and tangible assets from losses.
  • Establishes and maintains systems and procedures for claims adjusting, records management, and data collection for risk management programs; conducts risk identification surveys; analyzes and measures risk exposure.
  • Determines insurance requirements for outside contracts or events on City property and reviews insurance certificates; reviews bid verbiage to ensure the City is adequately protected.
  • Works closely with Purchasing, Legal, and other City departments to gather all pertinent information
  • related to outside contracts that are not typical and must use case-by-case judgment to make appropriate insurance recommendations.
  • Conducts internal and external claim investigations; obtains police reports or other records; secures estimates, billings, or other financial statements for damages incurred; document claims in written format as required.
  • Advises City departments regarding risk and safety concerns; provides research assistance when requested.
  • Keeps City management apprised of loss trends; coordinates meetings with Risk Management Steering Committee to review and address issues.
  • Compiles and analyzed data to develop and recommend to City management policies and administrative regulations regarding insurance programs with high self-retention and public liability.
  • Hires, supervises, trains, and evaluates the performance of direct reports.
  • Keeps abreast of new safety, tort laws, workers’ compensation legislature, and litigation.
  • Regular and consistent attendance for the assigned work schedule.
  • May be required to work evenings and weekends.

Marginal Duties:

  •          Performs other duties as assigned.

Typical Decisions: The incumbent determines appropriate funding through evaluation of previous losses and actuarial analysis. The incumbent is responsible for deciding the most efficient and effective manner of handling claims against the City. The incumbent is responsible for formulating methods of handling risks, formal insurance coverage with large self-retentions, risk reduction, and the mitigation of hazards. The incumbent determines the liability of the City for claims presented for damage incurred by individual’s and establishes appropriate safety training programs for employees. The incumbent is responsible for the allocation and expenditures of the division’s budget and for effectively supervising assigned staff. The incumbent will make decisions on a claim by claim basis – up to a specific dollar threshold – as to whether it is appropriate to pay specific claims.

Minimum Qualifications:

Knowledge of: Risk management principles and procedures; state laws relating to workers; compensation, tort liability, and applicable safety legislation; management principles and practices including budgeting and supervision; aspects and operations of City government and applicable Texas state laws including workers; compensation; insurance policies and claims handling techniques, and public sector practices and principles.

Skill in: Understanding and interpreting laws, rules, and regulations relating to risk management; analyzing complex programs; prescribing and formulating remedial policies and programs; communicating and interacting effectively with attorneys, employees and their representatives, members of the public and insurance carries; delivering effective presentations; planning and directing the work of others; investigating and analyzing data for the adjustment and evaluation of accidents and injuries.

Education: Bachelor’s degree in Risk Management, Business, Insurance, or a related field.

Experience: Five (5) years of progressively responsible experience in risk management and workers’ compensation. Experience must include two years of supervisory experience; one year of experience as a Risk Manager in a municipal environment; and three years of active experience in claims adjusting management.

Any work related experience resulting in acceptable proficiency levels in the above Minimum Qualifications is an acceptable substitute for the above specified education and experience requirements

Licenses and Certifications: Requires Texas Class C driver’s license (must obtain within 30 days of hire per state law). Must have an Adjuster- All lines license issued by the Texas Department of Insurance, or must obtain license within one (1) year of appointment. Certification as an ARM (Associate in Risk Management) or ARM-P (Associate in Risk Management for Public Entities) issued by the Insurance Institute of America is preferred.

Conditions of Employment: Must pass a drug test, driver license check, criminal history background check, periodic CJIS background check (for positions requiring access into Police buildings) and social security number verification check.

Physical Demands and Working Conditions: This is primarily a sedentary office classification although standing in work areas and walking between work areas may be required. Finger dexterity is needed to access, enter, and retrieve data using a computer keyboard or calculator and to operate standard office equipment; vision to read printed materials and a computer screen; hearing and speech to communicate in person and over the telephone. Positions in this classification occasionally bend, stoop, kneel, reach, push, and pull drawers open and closed to retrieve and file information. Employees must possess the ability to lift, carry, push, and pull materials and objects weighing up to 25 pounds.

Employees work in an office environment with moderate noise levels, controlled temperature conditions, and no direct exposure to hazardous physical substances. Employees may interact with upset staff and/or public and private representatives in interpreting and enforcing departmental policies and procedures.
